Pedophilia is a multifactorial personality in the personality of those who suffer from it, and it is formed by mental, institutional, activity, sex education, violence, and drive control aspects. The man appealed his conviction with the argument that the delays in his original trial violated the Colorado state statutes that guarantee a quick judicial process and the state Court of Appeals gave him the reason why he overturned his conviction and determined that he could not be judged again.

The decision touched prosecutor Dan Rubenstein, who said the ruling was something he never thought would happen. In declarations to the channel of television KREX 5 News the public prosecutor assured to be completely horrified by the decision. It seems offensive that the justice system allows things like this to happen.

The specialist also explained that there are two types of quick trials: the constitutional and the state. With the first, there is no time frame to solve the case, but in Colorado, the statutes require a period of six months. Rubenstein also claimed to have requested a certificate through the office of the attorney general who makes the appeals, requested a certificate to the Supreme Court to see if they would revoke the decision of the Court of Appeals, and they decided not to hear the case, and left the final decision of the Court of Appeals.

Because of that decision, McFadden was released from the Arkansas Valley prison, which caused outrage to many families. For the prosecutor, this is a clear example that the justice system completely failed. McFadden, who does not even have to register as a sex offender, was charged and convicted of raping six boys and girls in Grand Junction, Colorado, in 2015.

According to medical points of view, pedophilia is a paraphilia that lies in the excitement or sexual pleasure that is achieved, essentially through activities or sexual fantasies with children between 8 and 12 years. Considered a psychiatric disorder, pedophilia is the state in which an older adult or adolescent experience primary or exclusive sexual attraction to prepubertal children. Whoever is diagnosed with pedophilia must be at least 16 years old, and at least 5 or 6 years older than the prepubertal child, so that the attraction is diagnosed as pedophilia.
